END-USER LICENSE AGREEMENT FOR IgniteFusion APPLICATION IMPORTANT READ CAREFULLY: This End-User License Agreement (EULA) is a legal agreement between you (either an individual or a single entity) and IgniteFusion for the IgniteFusion software programs. By installing, copying, or otherwise using the IgniteFusion Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this Agreement, you are not authorized to use the IgniteFusion Software. This End-User License Agreement governs use of the IgniteFusion Software. Grant of License: You can freely use IgniteFusion on as many machines as you wish. You can use the same key on any machine and it will work. The only reason we ask people to register is so we can estimate how many users we have. Server License ("SL") Rights and Restrictions. Promise: IgniteFusion does not spam, spy or otherwise bother infringe on its users privacy. Intellectual Property Rights: IgniteFusion shall retain all right, title and interest, including all intellectual property rights, in and to the Ignite Software. You acknowledge that international copyright laws and international treaty provisions protect IgniteFusion Software and agree not to remove any copyright or other proprietary or product identification notices contained thereon. The Software Products are licensed, not sold. IgniteFusion, Inc. reserves all rights not expressly granted to you. You may not (i) remove, destroy, alter, obscure or modify any intellectual property notices included in the IgniteFusion Software; (ii) use, copy, sublicense, rent, sell, assign or transfer the license granted pursuant to this Agreement, or the IgniteFusion Software, except as expressly provided in this EULA, (iv) sublicense, rent or lease the IgniteFusion Software, or (v) reverse engineer, reverse compile, modify, reduce to human perceivable form, or disassemble IgniteFusion Software. Disclaimer of Warranties: Note: Do not blame us if you write bad code and destroy your machine or do any other crazy stuff. THIS IgniteFusion SOFTWARE AND DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. IgniteFusion AND ITS LICENSORS DISCLAIM ALL WARRANTIES OR CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OF THIRD PARTY RIGHTS, AND THOSE ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE, WITH RESPECT TO THE IgniteFusion SOFTWARE. IN PARTICULAR, LICENSEE OR ITS LICENSORS DO NOT WARRANT THAT USE OF THE IgniteFusion SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE. Limitation of Liability: IN NO EVENT IS IgniteFusion OR ITS LICENSOR(S) LIABLE FOR ANY DAMAGES, INCLUDING ANY LOST PROFITS, LOST REVENUE, LOSS OF BUSINESS, LOSS OF USE OR DATA, INTERRUPTION OF BUSINESS, LOST SAVINGS OR OTHER INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES OR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE IgniteFusion SOFTWARE EVEN IF IgniteFusion HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Termination: Your rights under this EULA terminate upon the completion of the Licensed Purpose, or without prejudice to any other rights, IgniteFusion may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you return all copies of the IgniteFusion Software immediately to IgniteFusion or you must destroy all copies of the IgniteFusion Software and send proof of such destruction.
